Flying charters provides medical transport services by charter Air Ambulance aircraft, as per the terms & conditions mentioned below:

  • Before making flight arrangements, our Medical Expert will consult with the patient’s physician and evaluate the patient’s medical condition, as it relates to air travel, and confirm "fit-to-fly" status. Arrangements are made according to medical requirements on case to case basis.
  • If at the time of boarding, the condition of the patient is found to be worse than the information provided, transportation may be refused. In such situations, compromising on the safety or operation of the patient and/or the Aircraft will not be accepted and Flying charters shall not be liable to provide any reasons for flight cancellation.
  • The final decision and responsibility to transport the patient will be with Flying charters and neither the client/patient attendant nor any third party would impose this decision on Flying charters in the best interest of the patient safety and care.
  • Flying charters staff and/or the pilot reserves the right to refuse to allow any attendant or baggage inside the Aircraft and/or de-plane such baggage and/or passenger in case the pilot in his sole discretion finds it suitable for the safety of the flight and/or if the total payload weight exceeds the permissible limit.
  • Flying charters shall not be responsible in case of any diversion or delay in the flight route and/or schedule which may be caused by any reason which is beyond the control of Flying charters
  • The operation of the Air Ambulance flight shall be solely dependent on conditions including but not limited to, permission from ATC/Airport authorities, weather conditions, security reasons.
  • Flying charters shall charge a net amount inclusive of aircraft flying charge, on-board medical team and other involved logistic costs.
  • Flying charters shall accept and confirm the air ambulance booking to the client/patient only after full 100% payment is received in advance and only then the scheduled departure of the flight will commence.
  • Payment can be made by Cash/ Bank A/C/ Online Transfer/ Debit Card/ Credit Card in the name of "Flying charters". Payments made by Proprietary/Private Limited/ Limited Company or by any other firm, TDS of 2% under section 194/C has to be deducted by the client and filed with the IT department.
  • The Flying charters air ambulance service shall be activated within two hours after receiving a 100% payment from the client/patient. In case of any activation delay due to unforeseen reasons, Flying charters shall communicate the same to the client/patient and keep them informed on the status.
  • Flying charters service is subject to the availability of aircraft, airworthiness, and weather condition. Flying charters is not responsible if any technical snag develops in the aircraft which cannot be rectified within the time limit and affects the flight operation.
  • In case, the flight has to be diverted to some other sector due to bad weather or for technical reason/s or VVIP/VIP flight movement or for re-fuelling at the destination airport or due to non-availability of the parking space or night landing facilities at the destination airport, the client shall not hold Flying charters responsible for the delay or timely execution of the ambulance flight. All quote estimates are based on the distance and cruising speed of the aircraft in nil wind conditions and any additional cost implications due to delay/diversion as mentioned above have not been taken into consideration. The final invoice will be based on actual flying time and the waiting period on the ground which shall include the cost of aircraft rental, crew salaries, maintenance, insurance, fuel, navigation charges, landing, and parking charges.
  • Flying charters liability shall be limited to the extent that is covered and indemnified by the Insurance company under which the Insurance policy is taken for the particular Aircraft.
  • FORCE MAJURE: Flying charters shall not be held responsible for non-operation of the air ambulance flight for any unforeseen reason/s such as Bad Weather, Poor Visibility, Non–Availability of clearances from ATC / Defense Authorities / Civil Administration. In that case, Flying charters is only liable for refunding the full payment amount (other than Airport charges paid) back to the client or shall reschedule the air ambulance flight for a later date and/or time as mutually agreed with the client.
  • CANCELLATION POLICY:
    • After confirmation of Flying charters Air Ambulance flight: 10% of the total cost will be cancellation charges and balance 90% will be refunded.
    • 12 hours before commencement of flight: 50% of the total cost will be cancellation charges and balance 50% will be refunded.
    • No Show: No Refund will be given.
    • If cancellation is done after the departure of the flight from the base station, No Refund will be given.
  • Baggage Restrictions: Medium size baggage is allowed with a dimension of HEIGHT: 26 INCHES and WIDTH: 18 INCHES on board the air ambulance flight.
  • Arbitration: In the event of disputes, differences or claims between the parties hereto, arising out of this agreement or in any way relating thereto, or any term, condition or provision herein mentioned or the construction or interpretation thereof or otherwise in relation thereto, the parties shall first endeavor to settle such differences, disputes, claims or questions by friendly mutual discussion. Failing settlement by friendly mutual discussion, the same shall be referred to the arbitration of person to be appointed by Flying charters. The jurisdiction of Arbitration will be Mumbai, Maharashtra.
